1 Urgent Matters

Item 4

The reasons for urgency were:

  • The works were critical for the John Chilton School, to enable the school to accept additional pupils, as planned for September 2020 and have the accommodation ready for them in October.  The business case for the expansion was that it provided better value for money than provision through external providers
  • If the decision was not taken and implemented very urgently, the opportunity to carry out the works during the long summer school close-down period would be lost, and with it the possibility of completing the works in time for the autumn intake

The report was late because the recommended contractor, who was the most economically advantageous and recommended following a competitive tender process, was more expensive than originally anticipated – which took the decision into “key decision” territory.  (A decision to award at a cost of less than £500k would not have required the use of any urgency provisions). Cabinet approved the tender exercise, and authorised Judith Finlay to take the award decision, at its meeting on 17th March 2020.

Urgent pursuant to the following procedures:

  1. Rule 4 (c) of the Access to Information Procedure Rules (meeting called at less than five clear working days’ notice). 
  2. Rule 16 of the Access to Information Procedure Rules  (impractical to comply with Forward Plan requirements).  The chair of the Overview and Scrutiny Committee (OSC) and the Leader of the Opposition agreed that the making of the decision was urgent and could not reasonably be deferred. 
  3. Rule 16 of the Scrutiny Procedure Rules (exemption from call-in): Chair of OSC and the Leader of the Opposition agreed that the decision proposed was reasonable in all the circumstances and to it being treated as a matter of urgency. 

The decision must then be reported to the next available meeting of full council, together with the reasons for urgency.
